1. Acceptance of Terms

Welcome to Taste Drinks Pty Ltd (“we”, “our”, “us”). By accessing or using our website, placing an order, or purchasing our cold-pressed juice products (“Products”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not use our services.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to purchase Products from us.

3. Products and Availability

3.1. We strive to ensure our Products listed on our Shopify store are accurate and up-to-date. However, we do not guarantee availability of any Product at any time.

3.2. In the event that a Product is out of stock or unavailable after an order has been placed, we reserve the right to:

• Cancel the order in full or in part; and
  
  

• Offer an alternative Product or a store credit at our discretion.
  
  

3.3. We are under no obligation to supply Products where incorrect pricing or information has been displayed due to technical errors, human mistakes, or system issues.

4. Orders and Acceptance

4.1. All orders are subject to acceptance by us. We reserve the right to reject or cancel any order for any reason, including but not limited to:

• Stock unavailability;
  
  

• Errors in pricing or Product descriptions;
  
  

• Suspected fraudulent transactions; or
  
  

• Any circumstances beyond our control.
  
  

4.2. An order is deemed accepted when we send you an order confirmation email.

4.3. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

5. Pricing and Payment

5.1. All prices are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless otherwise stated.

5.2. We reserve the right to change prices at any time without prior notice. The price payable is the price displayed at the time your order is confirmed.

5.3. Payment must be made in full at the time of placing an order. We accept payment through the methods available on our Shopify platform.

6. Shipping and Delivery

6.1. We will use reasonable endeavours to process and ship orders promptly. However, delivery times are estimates only and we do not guarantee any specific delivery date.

6.2. We are not liable for any delays, lost shipments, or delivery failures caused by third-party carriers, natural events, or other circumstances beyond our control.

6.3. Risk of loss and title to the Products pass to you upon our delivery of the Products to the carrier.

7. Cancellations and No Refund Policy

7.1. Once an order is placed, it cannot be cancelled or modified by you unless expressly agreed to in writing by us.

7.2. We have a strict no-refund policy, except as required under the Australian Consumer Law (“ACL”).

7.3. Where permitted by the ACL, we may offer a store credit or replacement at our discretion, but no cash refunds will be provided.

8. Faulty or Damaged Products

8.1. If a Product is faulty or damaged upon receipt, you must notify us in writing within 24 hours of delivery with supporting photographic evidence.

8.2. We will comply with our obligations under the ACL to provide a remedy, which may include repair, replacement, or refund, depending on the nature of the defect.

9. Intellectual Property

All content on our website, including but not limited to logos, images, product descriptions, and designs, are the intellectual property of Taste Drinks Pty Ltd and may not be used, reproduced, or distributed without our prior written consent.

10. Limitation of Liability

10.1. To the fullest extent permitted by law, we exclude all liability for any loss, damage, or claims arising from:

• The use of our website or Products;
  
  

• Any delays or cancellations of orders;
  
  

• Any indirect, incidental, or consequential losses.
  
  

10.2. Our total liability in relation to any claim will not exceed the purchase price of the Product in question.

11. Force Majeure

We are not liable for any failure or delay in performance caused by events outside our reasonable control, including but not limited to natural disasters, strikes, labour disputes, pandemics, or supply chain disruptions.

12. Amendments

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of our services after any changes constitutes your acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of NSW.
